1. Introduction and Scope
INDST.eu ("INDST", "we", "us", or "the Operator") is an independently operated, non-commercial infrastructure project providing private digital services and selected public technical resources.
These Terms of Service ("Terms") govern access to and use of INDST.eu websites, subdomains, applications, accounts, servers, infrastructure and related services (collectively, the "Services").
The Services include, but are not limited to:
- Identity, account management and authentication services.
- Email, webmail, messaging and communication services.
- Cloud storage, file hosting, file sharing and synchronization.
- Source code hosting and development tools.
- Game servers and management panels.
- DNS resolution and private networking.
- Monitoring, search, collaboration and productivity tools.
- Tor network infrastructure and Monero nodes.
- Additional existing or future services operated under INDST.eu.
This list is non-exhaustive. These Terms also apply to services that are not individually mentioned, unless separate terms are expressly provided. 2. Eligibility and Authorization
Access to Private Services is granted at the Operator's discretion and is not available through unrestricted public registration.
Users must obtain appropriate authorization before accessing restricted resources.
Accounts, invitations and access privileges are personal unless expressly stated otherwise.
Users must not sell, transfer, share or otherwise provide their access credentials to unauthorized third parties.
INDST may refuse requests for access, restrict specific services or impose additional authentication and security requirements.
Access to one Service does not automatically grant permission to access other Services.
3. Account Suspension, Revocation and Deletion
INDST reserves the right to suspend, restrict, disable or permanently delete any account, at its discretion, with or without prior notice, to the maximum extent permitted by applicable law.
Reasons may include, without limitation:
- Violations or suspected violations of these Terms.
- Security concerns or suspicious activity.
- Abuse of infrastructure or excessive resource consumption.
- Prolonged inactivity.
- Maintenance, migration or discontinuation of a Service.
- Legal or regulatory requirements.
- Withdrawal of an invitation or authorization.
- Other legitimate operational reasons.
Where permitted by law, account termination may occur immediately and without prior warning, explanation or opportunity to export data.
Termination may result in the permanent deletion of associated emails, files, repositories, messages, configurations, credentials and other stored information.
INDST does not guarantee continued account availability or that deleted accounts or their contents can be restored.
Users are responsible for maintaining independent copies of important information.
Where required by applicable law, mandatory notices, procedural safeguards, data rights and remedies will remain available.
Users may contact support@indst.eu to request a review of an account restriction. Such a request does not guarantee reinstatement.
4. Inactive Accounts
Accounts that remain unused for an extended period may be suspended, archived or deleted.
Unless otherwise specified for a particular Service, INDST may consider an account inactive after 12 consecutive months without meaningful account activity.
Inactivity may result in the removal of the account and its associated data, including stored files, mailboxes and repository contents.
INDST may perform such actions without prior notice where legally permitted.
Automatic background synchronization or system-generated activity does not necessarily constitute meaningful user activity.
INDST may also discontinue or remove unused Services independently of account inactivity.
5. Acceptable Use
Users must use the Services lawfully and responsibly.
Prohibited activities include, but are not limited to:
- Unauthorized access to systems, accounts or networks.
- Distribution of malware, malicious scripts or harmful software.
- Phishing, fraud, spam or credential theft.
- Hosting, distributing or sharing unlawful material.
- Infringement of copyright, trademarks, privacy or other third-party rights.
- Unauthorized scanning, exploitation or security testing.
- Harassment, threats or unlawful disclosure of personal information.
- Circumvention of security controls, quotas or access restrictions.
- Excessive resource consumption that interferes with other users or infrastructure stability.
- Using INDST resources to conduct or facilitate unlawful activities.
INDST may investigate reported violations and take proportionate technical or administrative action.
Legitimate testing of INDST infrastructure requires prior authorization.
6. User Content and File Hosting
Certain Services allow users to upload, store, synchronize, transmit, publish or share files and other information ("User Content").
Users retain ownership of their User Content and remain responsible for its legality, accuracy, origin and the rights required to use it.
By submitting User Content, users confirm that they have the necessary rights, permissions or other lawful grounds to store, process and share it through the Services.
Users must not upload or distribute:
- Copyrighted material without the necessary authorization.
- Files containing unlawfully obtained personal or confidential information.
- Unlawful, fraudulent or malicious content.
- Material that infringes applicable laws or third-party rights.
INDST provides technical infrastructure for hosting and processing User Content. Providing storage does not imply endorsement, approval, ownership or editorial control of that content.
INDST does not assume responsibility merely because a user stores or shares third-party content using the infrastructure. The allocation of responsibility and any legal exemptions remain subject to applicable law.
Users grant INDST a limited, non-exclusive permission to store, reproduce, transmit, back up and technically process User Content only as reasonably necessary to provide, secure and maintain the relevant Services.
This permission does not transfer ownership or grant INDST a general commercial license over User Content.
INDST is not generally required to proactively inspect all private files or communications, except where applicable law provides otherwise.
Where unlawful or infringing content is identified or sufficiently reported, INDST may restrict access, disable sharing, remove content, suspend accounts or take other lawful action.
Users remain responsible for obtaining any necessary consent from persons whose personal data they upload.
7. Third-Party Claims and Indemnification
Users are responsible for claims arising from their own unlawful conduct, unauthorized uploads or infringements of third-party rights.
To the extent permitted by applicable law, users agree to indemnify INDST against reasonable, documented losses, costs and expenses arising directly from their proven unlawful conduct or material breach of these Terms.
This provision does not apply to losses caused by INDST's own unlawful conduct, intentional wrongdoing or gross negligence, or where indemnification would otherwise be prohibited by law.
INDST does not automatically accept responsibility for disputes between users or between a user and a third party.
INDST may cooperate with competent authorities and respond to sufficiently substantiated legal complaints as required by law.
8. Service Availability and No Guarantees
All Services are provided free of charge, on an "AS IS" and "AS AVAILABLE" basis, without a Service Level Agreement (SLA).
To the maximum extent permitted by applicable law, INDST makes no express or implied guarantee regarding:
- Continuous service availability or uptime.
- Reliability, performance or suitability for a particular purpose.
- Preservation, accuracy or integrity of stored information.
- Compatibility with specific devices or applications.
- Uninterrupted network or Internet connectivity.
- Error-free operation or complete protection against cyberattacks.
- Recovery of deleted, corrupted or inaccessible data.
- Continued availability of a particular Service or feature.
Services may be modified, interrupted, restricted or discontinued at any time for legitimate operational, security or other reasons.
Status and monitoring information is provided for informational purposes and does not constitute a contractual availability commitment.
No monetary compensation, service credit or reimbursement is contractually promised for downtime, maintenance, suspension or discontinuation, except where applicable law requires otherwise.
9. Storage, Backups and Data Loss
INDST may employ backup, replication, synchronization and disaster recovery mechanisms. These mechanisms may vary between Services.
No universal backup, recovery point, recovery time or data restoration guarantee is provided.
Files or other information may be lost, corrupted, overwritten or rendered inaccessible because of hardware failure, software defects, configuration errors, account deletion, attacks or other incidents.
Users should maintain their own independent backups, particularly for important or irreplaceable data.
Storage quotas, retention limits and technical restrictions may be introduced or changed.
Data exceeding applicable limits may be restricted or removed, subject to applicable law.
Backup copies may continue to exist temporarily after deletion from a live Service, in accordance with technical retention procedures and legal requirements.
Nothing in this section limits mandatory obligations concerning data protection, security or lawful data retention.
10. Privacy, Communications and Security
INDST may process personal data to operate, secure and administer the Services.
Details of data processing, retention and applicable rights are provided in the Privacy Policy:
https://legal.indst.eu/privacy
The use of encrypted connections does not necessarily mean that all stored information or communications are end-to-end encrypted.
Users should not assume that email, cloud storage, backups and messaging Services provide identical encryption or privacy guarantees.
Technical and organizational security measures may include access controls, authentication, monitoring, encryption, firewall rules and software updates.
No technical environment can be guaranteed completely secure.
INDST may take reasonable action to investigate incidents, protect infrastructure, prevent misuse and comply with applicable law.
No provision of these Terms waives statutory data protection rights or excludes liability that cannot lawfully be limited.
11. Public Infrastructure and Third-Party Networks
INDST may operate restricted DNS resolution, Tor relays or bridges, Monero nodes and other public or private infrastructure components.
Such resources are provided on a best-effort basis.
DNS
INDST operates a private DNS resolution service, including dns.indst.eu, intended exclusively for the Operator and specifically authorized users, devices or networks.
The service is not offered as a public recursive DNS resolver. Access from unauthorized clients may be technically restricted, refused or blocked.
The availability of a public hostname does not imply public authorization to use the service.
INDST does not guarantee uninterrupted resolution or availability of any particular domain.
Tor
INDST may operate guard, middle, bridge or internal Tor-related infrastructure and provide Tor connectivity for selected technical services.
The infrastructure does not intentionally provide public Tor exit functionality unless explicitly stated otherwise.
INDST does not guarantee anonymity, privacy or uninterrupted connectivity for users of third-party anonymity networks.
Monero
INDST may operate Monero nodes accessible through conventional networks or Tor.
Such nodes provide technical connectivity to decentralized infrastructure and do not, by themselves, constitute custodial wallet services, cryptocurrency exchange, investment advice or financial intermediation.
INDST does not guarantee transaction confirmation, blockchain availability or recovery of users' cryptocurrency assets.
Users remain responsible for their own wallets, keys, transactions and lawful use of these networks.
12. Resource Management and Technical Restrictions
INDST may implement storage quotas, bandwidth limits, rate limits, security filtering and other technical measures.
Resource allocations may be adjusted to maintain security, stability and fair access.
INDST may temporarily restrict or terminate workloads that create significant operational or security risks.
Users must not circumvent restrictions or intentionally degrade service quality for others.
INDST may replace software, migrate infrastructure or discontinue obsolete technical components without guaranteeing backward compatibility.
13. Third-Party Software and Dependencies
The Services may rely on third-party software, open-source projects, networks, hosting providers and external technical components.
Their availability, behavior and security may be outside INDST's direct control.
Third-party licenses and legally applicable conditions remain in force.
INDST does not guarantee uninterrupted operation of dependencies, integrations or external networks.
Where separate third-party terms apply, users remain responsible for complying with them.
14. Limitation of Liability and Financial Claims
The Services are provided without charge as part of a personally operated, non-commercial infrastructure project.
To the fullest extent permitted by applicable law, INDST excludes liability for indirect, incidental, consequential or purely economic losses arising from the use of, inability to use or interruption of the Services.
This includes, where legally excludable, claims involving:
- Service downtime or interruption.
- Loss of anticipated profits or business opportunities.
- Loss of access to accounts or content.
- Incompatibility or unavailability of software.
- Delayed transmission or processing of information.
- Costs of substitute services.
- Discontinuation of free technical resources.
No voluntary financial compensation, monetary reimbursement or service credit is provided solely because of Service failure, account deletion, loss of access or data unavailability.
Any limitation of liability operates only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, breaches of mandatory obligations, or any damages for which exclusion or limitation is prohibited.
Any legally enforceable right to compensation or other mandatory remedy remains unaffected, with a maximum compensation limit, where legally allowed, of the amount paid to INDST in the last 365 days.
15. Content Reports, Abuse and Legal Requests
Suspected unlawful content, copyright infringements, security vulnerabilities and infrastructure abuse may be reported to:
support@indst.eu
Reports should provide sufficient information to identify and assess the alleged issue, including the affected Service, relevant URL or resource identifier and a description of the concern.
INDST may evaluate reports, request additional information and take lawful corrective action.
Possible measures include content removal, disabled links, restricted sharing, account suspension or preservation of relevant information where legally required.
INDST will comply with binding legal obligations and valid requests from competent authorities.
Nothing in these Terms authorizes indiscriminate monitoring of private communications.
Where applicable law establishes specific notice, explanation, complaint or redress requirements, those requirements take precedence.
16. Changes, Termination and Discontinuation
INDST may add, modify, replace or discontinue any Service or feature.
No Service is guaranteed to remain available indefinitely.
These Terms may be amended to reflect operational, security, legal or technical changes.
The current version will be available at:
https://legal.indst.eu/tos
Material changes will be communicated where reasonably practicable or legally required.
Where applicable law requires express acceptance of revised Terms, such acceptance will be requested.
17. Governing Law and Mandatory Rights
These Terms are governed by Italian law, subject to applicable European Union law and other mandatory protections.
Nothing in these Terms restricts non-waivable statutory rights or establishes an exclusive jurisdiction contrary to applicable law.
If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
Failure to enforce a particular provision does not automatically constitute a waiver of future enforcement.
These Terms do not create an employment, agency, partnership or commercial representation relationship between INDST and its users.
18. Final Provisions and Contact
These Terms describe the general conditions applicable to the Services. Additional specific conditions may apply to individual resources when expressly communicated.
The headings are provided for convenience and do not independently modify the meaning of the provisions.
In the event of translations, the English version is the reference text, without prejudice to mandatory applicable language requirements.
